Section 1 - Introduction
Welcome to Will Pembroke Photography! These Terms and Conditions outline the rules and regulations for using our website and purchasing products. By accessing this site and placing an order, you accept these Terms and Conditions in full.
Any reference to "we," "us," "our," or similar terms in these Terms and Conditions or any policy offered on this site refers to Pembroke Photo (our legal business name)
Section 2 - Products
We offer custom-made photography products, including framed prints, matted prints, prints, canvas prints, and metal prints. All products are made to order and are available in various sizes: XL, L, M, S, or specific sizes (A1, A2, A3, A4).
Please note that product descriptions and sizes are clearly stated on the product page, and by placing an order, you confirm that you have reviewed and agreed to the product details.
Section 3 - Order Process
Orders can be placed through our online store, and confirmation will be sent via email.
Once an order is placed, production will begin, and orders cannot be canceled, changed, or modified.
We outsource the printing of our products to a trusted third-party printer, which may affect production and delivery times.
Orders are not shipped or delivered on weekends or public holidays.
Production and shipping typically take 1–3 weeks, but this is subject to change based on demand, production timelines, and our printer’s schedule.
Section 4 - Pricing and Payment
We do not currently charge GST, as we are under the threshold, but this may change in the future.
We do not offer discounts at this time, but promotions may be introduced in the future.
Payment can be made via PayPal or credit cards using PayPal and Stripe. Full payment is required at the time of order.
Section 5 - Payment Security
We use secure third-party payment providers (PayPal and Stripe) to ensure your payment information is handled safely. We do not store any payment information on our site. All transactions are encrypted and processed securely by these providers.
Section 6 - Shipping and Delivery
We take great care to package products securely and use trusted third-party printers and carriers for delivery. While Pembroke Photo uses a third-party printer for production and shipping, we remain responsible for ensuring that the product arrives safely and in good condition.
If the product is damaged during shipping, including broken glass in frames, please contact us immediately to arrange for a replacement or refund. In the case of broken glass, it may also be possible to have the glass replaced by a local framer, and we can assist in coordinating this if needed.
While we are not responsible for delays caused by the carrier, we are responsible for the product until it is delivered to you.

Section 7 - Refund & Exchange Policy
We have a separate refund policy. Please review this policy before placing an order.
Section 8 - Intellectual Property
All content on this site, including photographs, is the exclusive property of Pembroke Photo and is protected by copyright law. No part of this website or its content may be reproduced or used in any manner without our prior written consent.
Purchased prints are for personal use only and may not be reproduced, copied, or resold without our explicit permission.
Any requests for resale must be directed to us via email.
Section 9 - Errors and Inaccuracies
We strive to ensure that all information on our website is accurate and up to date. However, we reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. If an error occurs with pricing, availability, or descriptions, we will notify you and offer the option to confirm or cancel your order.
Section 10 - Cancellation by Pembroke Photo
We reserve the right to cancel an order if we are unable to fulfill it due to errors in pricing, stock availability, or other unforeseen circumstances. In such cases, you will be notified, and any payments will be fully refunded.
Section 11 - Customer Responsibilities
Customers are responsible for ensuring that all information provided, including shipping details and order specifics, are accurate. Pembroke Photo is not liable for delays or issues caused by incorrect information provided by the customer.
Section 12 - Returns for Repairs
In the case of product damage that requires repair after delivery, please contact us to discuss potential repair options. Where possible, we will work with you to facilitate repairs locally.
Section 13 - Force Majeure
We are not liable for any delay or failure to fulfill orders due to circumstances beyond our control, including but not limited to natural disasters, government actions, strikes, pandemics, or supply chain disruptions. In such cases, we will contact you to discuss alternative arrangements.
Section 14 - Dispute Resolution
If you have any disputes or concerns regarding your purchase, we prefer to handle them through direct communication. If a resolution cannot be achieved, disputes will be governed by Australian law.
Section 15 - Limitation of Liability
We limit liability for any differences between the product and the digital mockups on the website. We are not responsible for:
Any variation in frame appearance from the stock images used for mockups.
Customer confusion regarding product size or type ordered.
Any delays in shipping caused by the carrier.
However, in accordance with Australian Consumer Law, we remain liable for ensuring products arrive in good condition and for offering remedies if the product is faulty, damaged, or not as described. Nothing in these Terms and Conditions excludes, restricts, or modifies your rights under the Australian Consumer Law.
By purchasing from Pembroke Photo, you agree that we are not liable for any of the above-mentioned factors. You acknowledge that digital mockups of frames are for representation purposes only.
Section 16 - Stock Images and Digital Mockups
Photos of frames and other products displayed on our site are stock images and represent digital mockups. These are not exact representations of the final product.
